Terms and Conditions as at 16/01/09
PROMOTION OVERVIEW
VisitScotland's Drive It Home promotion allows participants to claim a free four-ball at
selected golf courses in Scotland between April-October 2009. The promotion is open
to residents of participating countries except the United Kingdom. Participants receiving a
free four-ball voucher must travel to Scotland to claim their free four-ball and are responsible
for making their own travel and accommodation arrangements in this regard. The sequence
to claim a four-ball voucher follows:
COMPETITION TERMS AND CONDITIONS<
1 These are the rules ("Rules") for participation in this promotion. If you do not wish to accept these terms and conditions in their entirety, please do not submit an online application to us. By participating in the promotion you will be deemed to have read and accepted all of the terms and conditions. Failure to comply with any of these Rules will disqualify you from taking part in the competition.
2 Entry to the competition is available via digital entry at one of three websites; www.driveithome2009.com, www.driveithomescotland.com and www.driveithome.se (the "Web Site"). The competition is free and open to participants over 18 years of age, who are a legal resident in one of the participating countries. The participating countries are: United States of America, Canada, Sweden, France, Middle East, Germany, Italy, Australia, New Zealand, Hong Kong, Japan, China, Argentina, Brazil, Switzerland, Austria, Norway, Denmark, Finland and The Netherlands. Other countries may become involved at a later date. If so this list will be updated.
3 Employees of VisitScotland (the "Promoter"), its agencies, other associated companies and members of their families cannot participate.
4 Participants are required to fill in their personal details on the Web Site in order to claim a free four-ball. Please refer to VisitScotland's Privacy Policy for more information about your rights and the way we use your personal data.
5 Only claims submitted via the website and received in good order by VisitScotland between 21st January 2009 and 30th April 2009 shall be deemed valid and shall be taken into consideration. We cannot accept responsibility for lost or mislaid claims. Claims which are incomplete, illegible, lost or damaged, shall not be taken into consideration. VisitScotland accepts no liability whatsoever for any problems or any deficiency concerning computers, connections or networks used in submitting an entry through the Web Site.
7 Only one free four-ball may be claimed by each participant. The participant must provide the Promoter with their name and email address in advance of the four-ball being taken. To be eligible, the participant must also be resident of a participating country and must produce proof of residency upon redeeming their voucher at the eligible club. Golfers nominated to join a free four-ball (by the claimant) are not eligible to claim a free four-ball themselves and any attempt to do so will result in them being deemed ineligible for the Drive It Home promotion by the Promoter.
8 The sequence of claiming a free four-ball voucher is thus:
8.1 Upon claiming their free four-ball online at the Web Site, participants will be automatically and instantly emailed a voucher naming the Scottish golf course at which the voucher can be redeemed. At this stage, the voucher is provisional and requires validation (see 8.3). The voucher provides contact details for the eligible golf course.
8.2 Upon being issued the voucher, the participant has four weeks in which to contact the eligible golf course to book a date and time for their free four-ball and start planning their golf trip to Scotland. After the four weeks expire, the Promoter will email the participant requesting them to respond by email within 10 days, indicating their intention to travel to Scotland and claim their free four-ball.
8.3 If the participant responds by email confirming both their intention to travel to Scotland in 2009 and the date and time they've arranged for their four-ball, the Promoter will email a validation code to activate the voucher. If the participant doesn't respond to the email within the allowable 10 days or responds stating they will not travel to Scotland to claim their free four-ball, the Promoter will void their voucher.
9 There is no cash alternative to the free four-ball voucher. The free four-ball voucher may not be exchanged or traded and may only be redeemed by the original claimant, and only upon proof of residency of an eligible country at the point of redemption.
10 The four-ball voucher, once validated, may be redeemed for one free round of golf at the designated Scottish Golf Course between 13th April and 30th October 2009.
11 Arranging a date and time for their free four-ball is the responsibility of the participant, who is provided with contact details for the golf course at which their voucher is eligible. Eligible golf courses will be notified of all voucher claimants names and email addresses in order to verify participants when they contact the course.
12 Whilst the Promoter shall make best endeavours to ensure golf courses honour vouchers at the point of redemption, The Promoter will not be liable for instances where a participating course refuses to honour a voucher. Vouchers are redeemed at the sole discretion of participating courses.
13 Any entry made giving another person's (or a false) name or email address will be disqualified and will thus not be taken into account.
14 Participants redeeming valid four-ball vouchers are expected to observe the rules of golfing attire at the club allocated to them. This generally means trousers and shirt with collar. It's the responsibility of the participant to check with the club in advance. In addition, where clubs require a handicap certificate to play, responsibility for proof of handicap lies with the participant.
15 The Promoter reserves the right to cancel, change and alter any aspect of the Drive It Home promotion. Any such circumstance will be published on the Web Site.
16 If any provision of these Rules is found to be invalid by any court having competent jurisdiction the invalidity of such provision shall not affect the validity of the remaining provisions of these Rules, which shall remain in full force and effect.
17 This promotion is governed by UK law, which shall be exclusively applicable to any and all disputes arising out of or in connection with the promotion or these rules. UK courts shall have sole jurisdiction over any and all disputes arising out of or in connection with this promotion provided that such exclusivity does not apply to legal actions initiated or brought by the Promoter.
